I did my home work, met the appraiser and he agreed with me on value!

This was not an easy home to get an appraisal on; hardly a sure thing.  It's a great house and I   thought the sales price was right.  However, there wee few apples to apples sales matching or exceeding the sales price.   

I have had sales where I would have been shocked if a home didn't appraise, where I thought it was 50-50 as to whether a home appraised and when I thought there was no way it would appraise.  I always put the effort in to prepare and meet appraisers at the houses because you can't take things for granted.  Appraisers have professional formulas and don't always agree with realtors, sellers and buyers assessment of a home's value.  The most professional appraisers let agents make a case for the value when meeting at the property and, if the arguments are valid, the appraiser will consider the points made when generating his/her report.

You need a full service realtor who is going to do his or her homework and coordinate schedules so he or she can meet appraiser and prove the value.  There is never a guaranteed that a home is going to appraise, but if your realtor doesn't put in the effort to prove the value, then your realtor is putting your deal at risk.  

If a buyer's sales contract has an appraisal contingency and the home don't appraise, he/she has the right to try and negotiate the sales price with the sellers and if they don't come to an agreement, then the buyers have the right to get out of the contract and search for another home, while the sellers have to put their home back on the market, hoping to find another buyer and hoping the next appraisal comes in.  Nobody wins when a home doesn't appraise.

Home sellers: Think of yourselves as the buyers of this house. Was enough done?

A home seller shoveled enough snow so you can park at the end of the driveway and made a path from there to the front of the door so you don't have to walk in the snow - to the left of the path is driveway.  






Would you consider this to be enough, whether you owned and living at the house, were selling the house or buying the house?  Technically speaking you can park off the street and get to the front door cleanly. 

Legally, regarding property condition, snow removal is a tricky question as far as seller obligations, in a similar way to raking leaves. It depends on which real estate attorney you ask.

Either way, the good news is that the snow is melting.

On the heals of securing their home purchase at 12013 Kemp Mill Road, my clients were ready to sell their beautiful town home at 1102 Arcola Ave in Silver Spring, MD.  It's was beautiful 4 bedroom, 3.5 bath town home built in the 1980s with many features, including 2 main level living areas, a deck off of the updated kitchen and a spacious walkout basement.  The home is in an excellent location, just around the corner from a swim club, public transportation and a full service shopping center.

The sellers did a great job of keeping the home clean and staging it to sell. One of the sellers is a photographer so she took great photos of the home. We had a very active open house and were able to secure a contract in less than a month.

We recently settled and now my clients can just focus on loving their new home at 12013 Kemp Mill Road.

When these buyers approached me, they gave me very specific search parameters if they
were going to move.  They owned a town home and were ready for a single family home, if it had a very nice backyard and it was a nice fixer upper.  Like most town homes, they had a very small yard, which is good if you want low maintenance.  But, if you love the outdoors and you, your kids want to play outside, you need to go to the park.  There are several parks in the Silver Spring area but it is nice to have your own yard.  These clients also enjoy home improvement projects so they weren't turned away by old, outdated homes.

This home at 12013 Kemp Mill Road fit the bill perfectly.  While the home is on a "main street" it is very far set back, has a scenic feel and sits on just under an acre of land.  So it feels very private.  Beautiful yard, great play area and a great place to take photographs. One of my clients is a photographer.

The home also had a lot of charm and character but needed updating.  We learned through the home inspection of some big issues that had to be considered, and these issues definitely gave the buyers something to think about.  Fortunately, we were able to negotiate an amicable resolution with the sellers and it was a very pleasant transaction.

My clients love their home and have already done so much to it.  I am fortunate to also call them friends and it has been a delight coming over, watching the home transformation.  It almost feels like I am watching a realty show.  It is great seeing the smiles on their faces and how excited they are to have friends come over.

They should enjoy the home for many years and create many memories.

A short while ago, I walked out of settlement for 700 Hermleigh Road, a colonial home in Kemp Mill, a subdivision in Silver Spring, MD.  The sellers were referred to me by another client, who sold one home and bought another home with me in the last year or so.  The best compliment I can get is a referral from satisified clients, customers, family and friends.

This is a very unique home on just under a half an acre of land, with 5 bedrooms upstairs; a main level bedroom/au pair suite; featuring a kitchenette and private bath; a main level living room, dining room and kitchen; plus a lower level play area and a private office. 

The buyers are moving into the neighborhood from the Woodside area, another part of Silver Spring.  They live in a town home and with their growing family, it was time to find them to move.  Their best friends, live just a few houses away from 700 Hermleigh Road.  It's a very social block and subdivision, so I wish the buyers many new friends and memories at 700 Hermleigh Road.

Sellers who regret not selling their home


I've been working with buyers in a neighborhood where there is a small supply of
homes on the market that meet their criteria.

I contacted home owners who have taken their houses off the market during the last several months to let them know I am working with buyers in their neighborhood,if they know neighbors thinking of selling and/or if they're still interested in selling.

One former seller told me that someone inquired about renting his home shortly after their home was put on the market. The owners decided to rent the home out. Now the renter is 3 months behind on rent. The owners are irrate,beside himself and working on the eviction process,which is taxing and time consuming. They wish that they sold their home instead of renting it out,even though the market value of their home isn't where they want it to be.

They told me to call again at the end of the month to see where he is in the eviction process and if my buyer hasn't found a home yet. The sellers were reasonable and happy to talk with me about their situation,wanting to sell even though they are in a tough situation with their tenant.

As I tell all my clients, just because a home 'is not on the market' doesn't mean it isn't for sale. I keep my eyes and ears out for them. That is part of my marketing effort as their realtor.

Meanwhile, I will continue to explore other options for this buyer.

Check the names on the deed for your home today!



I got back from a listing appointment in Washington DC a short while ago and have a scenario:

To make a short story short...in mls and in tax records I looked up the owner(s) of X Street WDC 20037 and Jon Smith comes up as owner. I met with Mr. Smith's daughter who told me that she purchased the condo unit with her dad...at least with her name as well.
I reviewed a folder she had with the contract for purchasing the condo and the contract has both Mr. Smith and his daughter listed as buyers. Something seems to have gone wrong or astray.

I didn't see the name of the company who performed settlement and asked her to find out from her dad.

She didn't have a copy of the deed on her for me to see,so she'll ask her father about it.

The issues are at least the following: the goal was to set up the condo as a primary residence with daughter on title since daughter was living there while dad at home in Massachusetts. The plan was to set up the home as a primary residence where his daughter has in fact lived since the purchase and so he wanted her on the title for better interest rate on the mortgage. There are also tax implications (not related to and before the $8000 tax credit existed)..he might have not received first time DC home buyer tax benefits if home recorded as an investment property with an absentee owner (as opposed to a primary residence).
As is on the tax records if sold today,I believe the seller wouldn't be eligible for any capital gains benefits.

Currently as is I don't believe the daughter can sign any legal papers to list the home or to be any part of a sales contract without her father giving her power of attorney,since only he is considered "the owner".

Do yourselves a favor and check the title work for your home and make sure it reads currently,how it is intended andis it consistent with the sales contract you put on the home. If there are any problems or questions,contact the settlement attorney for your home.


So I have inquiries out to a couple of settlement attorneys who I have worked with to get their input on the matter and will tell the sellers my findings.

Yes,homes do sell on Christmas Eve


Interesting trend in Mongtomery County, MD and Washington DC, with the number of homes that sold and settled on Christmas Eve: 1998=0, 1999=9, 2000= 0, 2001= 12, 2002=20, 2003=31, 2004=16, 2005=0,2006= 1,2007=5, 2008=16, 2009...?. Does these numbers correlate to how you saw the market during these years? So,if you look at Christmas Eve as any kind of barometer,the real estate market has experienced a positive trend the last few years. May this trend continue.

It's a great day to buy a house. They may rather just sign and celebrate then have a tough back and forth negotiation that takes some joy out of their holiday.

Lender disclaimer as the date for The First-Time-Homebuyer Tax Credit Approaches. How to strategize if you are a buyer or a seller?


If you are a first-time-homebuyer and are counting on the $8000 tax credit with your purchase (double check with your lender on your eligibility and if you are eligible for the full amount),
check in with your lender and ask if his/her office/broker is making any disclaimers on their ability at this point in time to close your loan on or before 11/30/09 (currently people are lobbying to extend the date,but it hasn't been extended as of today).

I spoke with one lender yesterday whose company is sending out a disclaimer to buyers who they are working with, saying that the lender isn't liable if their loans don't close on or before 11/30/09. Why would a lender send out such a note? Things can happen that prevent settlements from closing and/or the loan from closing on the date of the proposed settlement.

The lender is protecting him/herself from potential claims/ law suits, if any first-time home decide to seek an $8000 claim from lenders (if 11/30/09 comes and passes and settlement on their new home hasn't occured). This is a good business move by the lender to cover him/herself. Will other lenders send out such a disclaimer to their clients? I would not be surprised. Lenders of course want your business. This lender is just making a disclosure the way home sellers make disclosures/disclaimers about their homes before buyers make a decision whether to go forward and make an offer on the home or to continue their home search.
I am meeting with buyers tonight to look at homes in Potomac and Rockville Maryland tonight. I will also discuss how a possible solution for them, if settling doesn't occur on or before 11/30/09. I also have a great strategy for sellers to make their homes more attractive to first-time homebuyers.
